OPEN COMMUNICATIONS Tanácsadó és Szolgáltató Korlátolt Felelősségű Társaság (registered office: H-1137 Budapest, Szent István park 16. II. em. 1; tax number: 12880270-2-41; Cg.01-09-707998; represented by: Ágnes Szőke (Managing Director) as the data controller (Controller) – on the basis of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“GDPR”) and the recommendations of the National Authority for Data Protection and Freedom of Information – provides the following clear and detailed information and sets out the following rules regarding the data to be provided in the form for contacting the Controller (hereinafter: Form) at Opencom.hu hereinafter referred to as: Website) operated by the Controller.

Please be informed that the purpose of the Controller is to provide information through the Website to potential customers interested in the services of the Controller and to potential employees interested in the Controller as an employer.

Given that, by filling in the form, business organisations with legal personality and other legal entities may also make an enquiry, within the meaning of the GDPR, the data of these entities (hereinafter referred to as: Customer) (in particular company name, company registration number, contact details) – as data of a non-natural person – cannot be considered personal data. However, the natural person representing the organisation falls within the personal scope of the GDPR, and it is therefore necessary to establish appropriate rules in relation to these persons.

This Policy and information will inform you about the processing of contact details when you fill in this form. We reserve the right to modify the provisions of this Policy unilaterally with the utmost of respect for your rights. We will inform you in advance if the modification concerns a substantial part (in particular the purpose, legal basis and duration of the processing).

If the person filling in the form is not acting on behalf of a legal entity Customer, but wishes to make a request as a natural person, the data processing rules will apply to him/her by applying the provisions of this Policy accordingly.

Our Company has taken into account the information under ref. no. NAIH/2018/3484/2/V issued by the National Authority for Data Protection and Freedom of Information in connection with this Policy.

Information to be provided by our Company in relation to personal data collected from the data subject pursuant to Article 13 of the GDPR:

Scope of personal data collected: ·         Name of data subject

 

·         Telephone number of data subject (if you do not wish to give a business telephone number)

·         Email address of the data subject (if the company email address (also) contains the name of the data subject, the email address is considered personal data too)

If you voluntarily give additional data to the Company besides the above, we will assess whether they are necessary for the purpose of the processing and for the performance of the Contract.

Purpose and legal basis for processing: The purpose of the processing is to facilitate and maintain the contact made during the completion of the form. The Controller will inform you in each case if it intends to use the data provided for any other purpose than that for which it was originally collected.

If the contact form is completed by a natural person, the personal data will be processed pursuant to Article 6(1)(b) of the GDPR, which states that the processing of the data is necessary for the purposes of taking action at the request of the data subject.

If the personal data belongs to an employee of the Customer or a person otherwise under the direction of the Customer, the personal data are processed pursuant to Article 6(1)(f) GDPR, in connection with which we have a balancing test prepared, which is available in Annex I to this information.

Persons entitled to access the data: The Data Protection Officer, the Company’s Managing Director and the persons authorised and directed by him/her are entitled, to the extent necessary for the performance of their duties, to access the personal data for the purposes set out above.
Duration of storing personal data: Contact details will be processed for 30 days from the date of contact. If a contract is concluded based on the request, the processing will be governed by the specific data processing rules relating to the concluded contract, which will be communicated to the data subjects at the time of the contract conclusion.

 

The contact person must notify us if the data subject’s legal relationship with the Customer has been terminated before the above deadline or if, for any other reason, the data subject is no longer a contact person and the purpose of the processing has therefore ceased to exist.

Rights of data subjects: In accordance with the provisions of the legislation, by sending an email to info@opencom.hu the Data Subject may request from the Controller access to, rectification, erasure or restriction of processing of the personal data concerning him or her, object to the processing of such personal data and submit a complaint to the National Authority for Data Protection and Freedom of Information (address: 1055 Budapest, Falk Miksa utca 9-11, ugyfelszolgalat@naih.hu; www.naih.hu).

 

Our Company will inform the Data Subject of the action taken in response to the request submitted according to the GDPR without undue delay and in any event within one month of receipt of the request. That period may be extended by two further months where necessary, taking into account the complexity and number of the requests. The Controller shall inform the Data Subject of any such extension within one month of receipt of the request, together with the reasons for the delay. Where the Data Subject makes the request by electronic means, the information shall be provided by electronic means where possible, unless otherwise requested by the Data Subject.

Limitation of liability in relation to processing: The Controller does not check the personal data provided to it. Only the person providing the data is responsible for their veracity. With regard to this assumption of responsibility, any liability related to the inaccuracy or untruthfulness of the data shall be borne solely by you as the Data Subject who provided the data.

 

The contact person is obliged to notify us if his/her legal relationship with the Customer has been terminated before the deadline set out for processing or if, for any other reason, he/she is no longer a contact person and the purpose of the processing has therefore ceased to exist.
